Terms and Conditions (T&C)
1. Scope
1.1 These Terms and Conditions (T&C) apply to all business relationships between the provider (Benc Orpak) and the customer.
1.2 Deviating, conflicting, or supplementary terms and conditions of the customer will not become part of the contract unless explicitly agreed upon.
2. Conclusion of Contract
2.1 The presentation of products or services on the website does not constitute a legally binding offer but an invitation to place an order.
2.2 By placing an order, the customer makes a binding offer to conclude a contract. The contract is formed when the provider accepts the offer.
3. Prices and Payment Terms
3.1 All stated prices are in euros or US dollars and include the statutory value-added tax, unless otherwise specified.
3.2 Payment can be made in advance, via PayPal, credit card, or other payment methods offered on the website.
3.3 The purchase price is due immediately upon conclusion of the contract.
4. Delivery and Shipping
4.1 The delivery of physical products will occur within the delivery time specified on the website.
4.2 Digital content (e.g., PDF files) will be made available to the customer after the order process is completed and payment is successfully received.
4.3 If a product or digital content is unavailable, the customer will be informed immediately. Payments already made will be refunded in such cases.
5. Right of Withdrawal
5.1 Right of Withdrawal for Physical Products
Consumers have a statutory right of withdrawal of 14 days.
5.2 Expiry of the Right of Withdrawal for Digital Content
The right of withdrawal expires for contracts concerning the delivery of digital content (e.g., PDF files) as soon as the provider has begun executing the contract. This applies regardless of whether the content has been downloaded, displayed, or otherwise used.
6. Retention of Title
Until full payment is received, the goods (physical products) remain the property of the provider.
7. Liability
7.1 The provider is only liable for damages caused intentionally or through gross negligence, as well as for damages resulting from injury to life, body, or health.
7.2 For slight negligence, the provider is only liable for breaches of essential contractual obligations (cardinal obligations).
8. Copyright and Usage Rights
8.1 All content offered on the website, including texts, images, designs, and digital content (e.g., PDF files), is protected by copyright.
8.2 Any use, reproduction, or distribution of the content without the provider’s explicit consent is prohibited.
9. Final Provisions
9.1 The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
9.2 If the customer is a merchant, the place of jurisdiction is the provider's registered office.
9.3 Should any provision of these T&C be invalid, the validity of the remaining provisions shall remain unaffected.
